Straight after the publication of those substances, information requirements according to article 33 of the REACH regulation apply to suppliers of articles.
In case a candidate substance is contained > 0,1 % in an article (threshold applies to any sub-article following the judgement of the EU-court of justice C 106/14), suppliers of articles have to inform their customers about the substance and provide information on safe use of the article.
New enforcement project in 2017 coming soon
It is expected that ECHA will run a new enforcement project, focusing on substances in articles in 2017. As the draft of the updated ECHA guidance document (considering the new interpretation of the reference value of the threshold of 0,1 %) has been presented in 2016, the publication of the final version is expected shortly.
