RoHS Exemptions Finalized: Key Updates, Expiration Dates & Compliance Guidance

The EU Commission has officially finalized the delegated directives amending RoHS exemptions under Annex III — marking a significant update for companies across the electronics, manufacturing, and supply chain sectors. These long-anticipated changes reshape how businesses manage exemptions and maintain material compliance under the RoHS Directive (2011/65/EU).

 

Major Changes in the Finalized RoHS Exemptions

Updated and More Specific Exemptions:
Commonly used exemptions such as 6(a)–(c) (lead in steel, aluminum, and copper alloys), 7(a) (lead in high-melting-temperature solder), and 7(c)(I)/(II) (lead in glass and ceramic components) will expire and be replaced by more specific sub-exemptions that reflect defined use cases and technical needs.

New Restrictions Introduced:
For the first time under RoHS, certain exemptions — e.g., 6(a)–(c) — cannot be used if products can be placed in the mouth of a child under normal conditions, introducing a new level of health and safety consideration.

Updated Expiration and Renewal Deadlines:
Most exemptions will expire by the end of 2027, with renewal applications due 18 months before expiration. For example, exemptions ending in June 2027 must be renewed by December 31, 2025.

 

What Companies Need to Do Now

Organizations that manufacture, supply, or use components covered by RoHS must:

  • Verify which exemptions currently apply and whether they remain valid under the new directive.
